Agreement to Terms
Welcome to ScoringTime®. These Terms of Use ("Terms") govern your access to and use of the ScoringTime platform, including our website at scoringtime.com, mobile-accessible web applications, agent dashboard, buyer scoring tools, open house scoring features, and any related services (collectively, the "Platform" or "Services").
By creating an account, clicking a registration button, or otherwise accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use the Platform.
Our Role
ScoringTime® is a buyer intelligence and property evaluation platform designed to help real estate buyers score and compare homes they visit, and to help real estate agents understand their clients' preferences and feedback. The Platform is a software tool — it is not a real estate brokerage, does not provide real estate advice, and does not facilitate real estate transactions.
Scores, notes, and comparisons generated through the Platform reflect the personal opinions and preferences of individual users and should not be interpreted as professional valuations, appraisals, inspection reports, or investment advice. ScoringTime® does not endorse, recommend, or represent any property, agent, brokerage, or listing.
Real estate agents using the Platform remain solely responsible for the professional advice they provide to their clients. Buyers remain solely responsible for their own home purchase decisions. ScoringTime® is a tool to support those decisions — not to make them.
Eligibility & Accounts
Age Requirement
You must be at least 18 years of age to use the Platform. By agreeing to these Terms you represent and warrant that you are at least 18 years old. If you are using the Platform on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
Account Registration
Certain features of the Platform require you to create an account. When registering you agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You may not share your account credentials with others. You may not create accounts using automated means or under false pretenses. You may not create an account if you have previously been suspended or removed from the Platform.
Account Types
The Platform currently offers the following account types:
- Free Buyer Account — available to any individual at no cost, with limited scoring capacity as described in our pricing page
- Agent Pro Account — a paid monthly subscription for licensed real estate agents and their clients
- Enterprise / Association Account — custom arrangements for MLSs, associations, and brokerages, governed by a separate agreement
Accurate Information
You agree not to misrepresent your identity, professional licensing status, or affiliation when creating an account. Real estate agents who represent themselves as licensed professionals in order to access Agent Pro features are responsible for maintaining that licensure in good standing.
Permitted Use
Subject to your compliance with these Terms, ScoringTime® grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purposes:
- Buyers may use the Platform to score properties they personally visit, take notes, upload photos, compare homes, and share their scored data with their real estate agent
- Agents with a Pro account may use the Platform to create client accounts, view client-generated scoring data, manage open house scoring sessions, generate QR codes, and use all tools included in the Agent Pro plan
- Enterprise partners may use the Platform as specified in their separate written agreement with ScoringTime®
All use of the Platform must comply with applicable laws and regulations, including fair housing laws, real estate licensing requirements, and consumer protection statutes.
Prohibited Use
By using the Platform, you agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation
- Reproduce, modify, distribute, reverse engineer, decompile, or create derivative works from any portion of the Platform without our express written consent
- Use automated tools, scripts, bots, scrapers, or crawlers to access or extract data from the Platform
- Attempt to gain unauthorized access to any part of the Platform, other user accounts, or our backend systems
- Upload or transmit viruses, malware, or any other malicious code
- Interfere with or disrupt the integrity, security, or performance of the Platform
- Use the Platform in any way that discriminates against any person on the basis of race, color, national origin, religion, sex, familial status, disability, or any other protected class under applicable fair housing or anti-discrimination laws
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Use the Platform to develop competing products or services, or to benchmark our Platform against competing offerings without our consent
- Post or transmit any content that is unlawful, offensive, harassing, defamatory, or otherwise objectionable
- Use another user's account or access another user's data without authorization
- Resell, sublicense, or otherwise transfer your access to the Platform to any third party without our prior written consent
- Attempt to circumvent any subscription or usage limits through technical means
Subscriptions & Fees
Agent Pro Subscription
The Agent Pro plan is a monthly recurring subscription billed at the rate shown on our pricing page at the time of purchase. All fees are in U.S. dollars and are non-refundable except as required by applicable law.
By subscribing you authorize ScoringTime® to charge your payment method on a recurring monthly basis until you cancel. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period — you will retain Pro access through that date and will not be charged for subsequent periods.
Free Trial
We may offer a free trial period for the Agent Pro plan. During a free trial, your payment method will not be charged. At the end of the trial period, your subscription will automatically convert to a paid subscription at the then-current rate unless you cancel before the trial ends.
Price Changes
We reserve the right to change subscription pricing at any time. We will provide you with advance notice of any price increase before it takes effect. If you do not accept the new price, you may cancel your subscription before the new rate applies.
Payment Processing
All payments are processed by Stripe, Inc., a third-party payment processor. By providing your payment information, you authorize Stripe to charge your payment method in accordance with these Terms and any applicable Stripe policies. Your payment information is transmitted directly to Stripe and is never stored on our servers. Your use of Stripe's payment services is subject to the Stripe Terms of Service.
Buyer Property Packs
Free buyer accounts include a limited number of property scores at no cost. When a free buyer account reaches its scoring limit, users may purchase a one-time property pack that adds additional scoring capacity to their account. Property pack purchases are:
- A one-time, non-recurring charge — not a subscription
- Non-refundable once purchased and applied to the account
- Tied to the specific account that made the purchase and are non-transferable
- Subject to the pricing shown on our pricing page at the time of purchase
Additional scoring capacity from a property pack does not expire and does not require any ongoing payment. Property packs do not unlock premium agent features — they expand scoring capacity for free buyer accounts only.
User Content
Your Content
The Platform allows you to submit content including property scores, notes, photos, and other information ("User Content"). You retain ownership of your User Content. By submitting User Content to the Platform, you grant ScoringTime® a limited, non-exclusive, royalty-free license to store, display, and transmit your User Content solely for the purposes of providing the Platform to you and your authorized users (such as your real estate agent).
We do not use your individual scoring data, property notes, or personal content to train machine learning models, for advertising purposes, or for any purpose beyond operating and improving the Platform.
Your Representations
By submitting User Content you represent and warrant that you own the content or have the right to submit it, that the content does not infringe any third party's intellectual property rights, and that the content does not violate any applicable law.
Our Rights
We reserve the right to remove any User Content that violates these Terms or that we determine in our discretion is harmful, unlawful, or otherwise inappropriate. We are not obligated to monitor User Content but may do so.
Aggregated Data
We may use de-identified, aggregated scoring data — data that cannot reasonably identify any individual user or property — for platform analytics, product improvement, and research purposes. No individually identifiable information is included in such aggregated data.
Third-Party Services
The Platform integrates with certain third-party services to provide its functionality. Your use of these services is subject to their respective terms:
- Stripe — payment processing. Subject to the Stripe Terms of Service and Stripe Privacy Policy
- Google Fonts — typography delivery via Google's CDN. Subject to Google's terms of service
- Email delivery providers — for transactional and notification emails
ScoringTime® is not responsible for the practices, content, or availability of any third-party services. Links to third-party websites do not constitute our endorsement of those sites or services.
Intellectual Property
The Platform and all of its content, features, and functionality — including but not limited to the software, code, design, user interface, scoring methodology, text, graphics, logos, and trademarks — are owned by ScoringTime® and are protected by United States and international intellectual property laws.
ScoringTime® is a registered trademark. You may not use our name, logo, or trademarks without our prior written consent. Nothing in these Terms grants you any right to use our intellectual property beyond what is expressly permitted.
Feedback
If you provide us with suggestions, ideas, or feedback about the Platform ("Feedback"), you grant us an unrestricted, perpetual, irrevocable, royalty-free right to use that Feedback for any purpose, including to improve the Platform or develop new features. We are not obligated to compensate you for Feedback.
Copyright & DMCA
We respect the intellectual property rights of others. If you believe that content on the Platform infringes your copyright, please notify us in accordance with the Digital Millennium Copyright Act (DMCA) by providing the following information:
- A physical or electronic signature of the person authorized to act on behalf of the copyright owner
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing and its location on the Platform (including a URL)
- Your name, address, telephone number, and email address
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf

We will respond to valid DMCA notices and remove infringing content as required by law. Repeat infringers may have their accounts terminated.
Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided through the Platform. Property scores and evaluations generated through the Platform are the personal opinions of individual users and do not constitute professional real estate, appraisal, inspection, or investment advice.
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you in full.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCORINGTIME® AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO SCORINGTIME® IN THE TWELVE MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow certain limitations of liability, so these limitations may not apply to you in full.
Indemnification
You agree to indemnify, defend, and hold harmless ScoringTime® and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or in any way connected with:
- Your access to or use of the Platform
- Your User Content
- Your violation of these Terms
- Your violation of any applicable law or the rights of any third party
- Any misrepresentation you make in connection with your account or professional credentials
Termination
You may close your account and terminate your use of the Platform at any time by contacting us at support@scoringtime.com or through your account settings.
We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including if we believe you have violated these Terms. If we terminate your account for a violation of these Terms, you are not entitled to a refund of any prepaid fees.
Upon termination, all licenses granted to you under these Terms will immediately terminate. Provisions that by their nature should survive termination — including intellectual property rights, disclaimers, limitations of liability, and dispute resolution — will survive.
We will retain your account data for a reasonable period following termination in accordance with our Privacy Policy and applicable law.
Dispute Resolution
Governing Law
These Terms and any dispute arising out of or related to them or your use of the Platform shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.
Informal Resolution
Before filing any formal legal claim, we encourage you to contact us at legal@scoringtime.com to describe the issue and give us an opportunity to resolve it informally. Most concerns can be resolved quickly this way.
Binding Arbitration
If we cannot resolve a dispute informally, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in Virginia or via videoconference. Each party will bear its own costs unless the arbitrator determines otherwise.
YOU AND SCORINGTIME® AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims.
Exception
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.
Changes to These Terms
We may update these Terms from time to time. When we make material changes we will update the "Last Updated" date at the top of this page and, where appropriate, notify you by email or through the Platform. Your continued use of the Platform after any update constitutes your acceptance of the revised Terms.
If you disagree with the revised Terms, your sole remedy is to stop using the Platform and, if applicable, cancel your subscription.
